Supreme Court refuses to accept Centre's plea in 2G spectrum case









Leader Online Desk : The central government's demand to revise the Supreme Court's decision in the 2G spectrum case has met with a setback. The Supreme Court's registry has rejected the Centre's petition. The Supreme Court Registry termed the Centre's plea as an attempt to review the Supreme Court's decision based on misunderstanding and in the name of clarification. In a 2012 Supreme Court order in the 2G spectrum case, the country's natural resources can only be allocated through auctions. The Center had sought an amendment in this decision.

Right to appeal to Central Government against decision of Registrar

As per Rule 5 of Rule XV of the Supreme Court, the Registry Division of the Supreme Court may refuse to entertain a petition. Under this rule, the Registrar can refuse to accept a petition without good reason or on the ground that it is a reprehensible matter. However, the petitioner can appeal against such order within 15 days.

What is the matter?

In an order dated February 2, 2012, the Supreme Court canceled licenses granted to various companies for 2G spectrum. All these licenses were given when A Raja was the Telecom Minister in the Manmohan Singh-led government. The court had said that allocation of natural resources in the country can be done through auction.

On April 22, Attorney General R Venkataramani filed an appeal before a bench of Chief Justice Dhananjay Chandrachud and Justice JB Pardiwala against the decision. It sought revision of the Supreme Court's 2012 decision in the 2G spectrum case. The Attorney General also demanded an early listing of the case. The central government sought an exemption from the auction of 2G spectrum for non-commercial purposes. A PIL filed by the NGO had opposed the Centre's plea. The Supreme Court had decided in 2012 on the petition of this NGO.
