Kangana's 'Emergency' will not be released on 6 September: Bombay HC reprimands CBFC, says- Clear the objections by 18 September and give certificate to the film

Kangana's directorial film 'Emergency' was to be released on 6 September. Now its release has been postponed for two weeks.

Makers of Kangana starrer film 'Emergency', Zee Studios had approached Bombay High Court seeking release of the film and censor certificate.

This petition was heard on Wednesday, September 4 by a bench of Justices B.P. Colabawala and Firdaus Pooniwala.

The Bombay High Court said it was unable to direct the CBFC to issue a certificate as it would be in contravention of the MP High Court order.

Kangana Ranaut directed film 'Emergency' was scheduled to release on 6 September.

The film will not be released on 6 September
The court also said that it cannot pass an order in this case so soon. A decision will be taken in this case by September 18 and the next hearing in this case will be held on September 19. In such a situation, Kangana's film 'Emergency' will not be released on September 6.

The board should clear the objections before 13 September
During the hearing, the court directed the CBFC to clear any objections to the film before September 13.

Also, reprimanding the board, he said that crores of rupees are spent on a film. You cannot escape from your responsibility regarding the certificate by declaring a holiday in the name of Ganpati festival.

In this film, Kangana will be seen in the role of former PM Indira Gandhi. Anupam Kher and Shreyas Talpade will also be in important roles.

How can you guess by watching the trailer: Court
During the hearing, the court said that the Sikh community found the film wrong after just watching the trailer and started protesting against it. How could they make such an assumption by watching the trailer?

Let us tell you that Jabalpur Sikh Sangat had raised objections to the film and its trailer and appealed to ban it in MP High Court.

The court reprimanded the CBFC lawyer
Earlier in the court, CBFC's lawyer told that the certificate which was first given to Kangana's film was a system generated mail but later it was stopped due to objections.

He also said that the certificate was emailed to the makers, but the physical copy was never posted.

The court asked the CBFC how can you send a system generated email? The court asked the CBFC lawyer if their officers initially saw the film and gave the certificate then why did they not use their brain? The court reprimanded that officer.

Now the next hearing of this case will be held on 19 September in Bombay High Court.

I wish you had argued in the same way in MP HC: Bombay High Court
The Court further said that the Madhya Pradesh Court has given clear directions that if we accept your petition today, we will be repealing the order of the Madhya Pradesh Court.

The court told the makers- 'We are with you, if only you had argued in the same strong way in front of the MP High Court, then it would not have happened that the CBFC chairman would not have signed. But now we cannot sign an order which is contrary to the order pronounced.

The court did not reject the petition of the makers
Finally the court said that they are not rejecting the petition of the makers. If there is a delay of a week, the sky will not fall. The makers should have first presented these arguments before the MP High Court.

The petition filed by the film makers claimed that the Censor Board has arbitrarily and illegally withheld the censor certificate of the film.

The lawyer appearing on behalf of Kangana Ranaut's production house said – We will not make any changes in the film and will release the film in the same way as the CBFC has sealed it.

The makers of the film also argued in the court that 1800 theatres are booked for the film and people have booked tickets in advance. The makers will suffer huge losses if its release is postponed.

Ji said- this will cause us a lot of loss
In a petition filed in the Bombay High Court, the film's producer company Zee had said that withholding the certificate is a violation of the Cinematograph Act. According to this Act, the certificate must be informed in the prescribed format within 5 days of submission.

Zee's argument is that without this certificate they will not be able to screen the film and will suffer huge losses. 1800 theatres are booked and people have booked tickets in advance. This will also violate their fundamental rights to freedom of expression and to pursue their profession.

MP High Court had said the matter is pending
Earlier, the CBFC (Central Board of Film Certification) had informed the Madhya Pradesh High Court that they have not yet granted the film a censor certificate. It was said that the Kangana Ranaut film is still under consideration and will not release on September 6.

After the film was banned, Kangana had given a statement that she would release it without any cuts.

Regarding the film 'Emergency', Sikh organizations alleged that their community and the events related to it have been distorted in the film.

After this, CBFC withheld the certificate of the film and ordered the makers to remove some of its scenes. However, the film's director Kangana does not approve of this. She says that she will release the film without any cuts.

In the film 'Emergency', Kangana has played the role of former Prime Minister of the country Indira Gandhi. Apart from her, actors like Shreyas Talpade and Anupam Kher will also be seen in it.
