Celebrities also liable for misleading advertisements: Supreme Court









New Delhi, Leading News Service: The Nirwala Supreme Court has given on Tuesday (7th) that celebrities and media influencers are responsible for false and misleading advertisements of any products.

A bench of Justice Hima Kohli and Justice Ahsanuddin Amanullah is hearing a petition filed by the Indian Medical Association against the publication of false and misleading advertisements by yoga guru Baba Ramdev's Patanjali Ayurveda Institute.

Before airing any advertisement, the broadcasters company should submit a self-attested application stating that we comply with the terms and conditions of advertisement, the court said in its decision. TV broadcasters will have to upload the announcement on their Broadcast Service portal. The court also directed to set up a portal for print media within the next four weeks.

The Supreme Court on this occasion referred to the 2022 guidelines regarding misleading advertisements. The court clarified that if any person publishes an advertisement, that person must have complete information about the product service. The court also directed to create a procedure for consumers to file complaints about advertisements.

The Supreme Court asked the central government why state and union territory AYUSH authorities were prevented from taking action under Section 170 of the Medicines and Cosmetics Act, 1945 against companies publishing false and misleading advertisements.
