Breaking: Kejriwal gets a shock; Arrest proceedings valid, High Court dismisses petition | leader


Leader Online Desk : The Delhi High Court today (April 9) gave its verdict on a petition claiming that the arrest of Chief Minister Arvind Kejriwal in connection with the Delhi liquor policy scam was illegal. Arvind Kejriwal's arrest by 'ED' in this case is valid, the court rejected the petition filed against the arrest action.

A hearing was held in the Delhi High Court on April 3 in this case. Senior advocate Abhishek Manu Singhvi argued on behalf of Kejriwal and Additional Solicitor General SV Raju on behalf of ED. After this, Justice Swarna Kanta Sharma reserved his decision.

It is clear from the evidence collected by 'ED' that Kejriwal hatched a conspiracy

The petition is to decide whether the ED's arrest of Kejriwal is illegal or not. The court clarified that the present petition is not for grant of bail. Kejriwal hatched a conspiracy and was involved in framing the excise policy. The court said that it is clear from the evidence collected by the ED that they used the proceeds of this crime.

Kejriwal will have the right to cross-examine the witnesses

It is not a question for the court as to who gives tickets to contest elections or who buys election bonds. Kejriwal will have the right to cross-examine the witnesses. The said person has to answer it at that stage. The Court also clarified that this Court cannot enter into the role of a Court of Session and entertain a small case within the writ jurisdiction.

ED has enough evidence to arrest Kejriwal. That is why they arrested Kejriwal. The bench also observed that Kejriwal's non-participation in the investigation and the delay caused by him also affected those in judicial custody. The files submitted by the ED before the court in this case show that all the laws laid down in the Pankaj Bansal case were followed. Justice Swarna Kanta Sharma also clarified while dismissing the petition that the order of the magistrate court was reasonable.

There is no prerogative for the Chief Minister

Political reasons cannot be brought before the court. The case before this Court is not a conflict between the Central Government and Kejriwal. So is the case between Kejriwal and ED. This court will not make a special privilege for the common citizens and one for the Chief Minister. Judges are bound by law, not politics. Justice Swarna Kanta Sharma also clarified that judgments are written according to legal principles.

The chain of money sent for Goa elections is clear

ED has submitted the evidence of hawala transaction in this case. ED has also given evidence that money was sent in cash for the Goa elections. Therefore, the bench observed that Kejriwal's arrest is not a violation of the law, and the ED's custody cannot be called illegal.

It is not within the jurisdiction of the ED to grant amnesty to a person who has sanctioned an illegal act. It is a judicial process. Kejriwal's plea was heavily argued on both sides

Kejriwal's lawyer Singhvi said that the timing of the arrest of Aam Aadmi Party leader Arvind Kejriwal is suspicious. During the hearing held on April 3, Additional Solicitor General S. V. Raju had said that it has been argued by the petitioner that this is not a petition to quash the arrest but a bail application. The investigation into the matter is at an early stage. The investigation in the case involving Kejriwal is not complete. Many of the accused in this case have been denied bail by the Sessions Court, one of the reasons for the denial of bail being the involvement in money laundering against the accused in this case. It is true that there was a scam in the Delhi liquor policy case. Indo Spirit was granted a wholesale license despite complaints of 'cartelisation'. This does not mean that the crime of money laundering has not been committed

The proceeds of this scam were paid in cash to a large number of individuals. This cash is not in the books of accounts. AAP's candidate has also accepted this. I have been given cash. So we have discovered the money trail. The fact that the money is not found does not mean that the crime of money laundering has not been committed. The petitioner has been making false statements in this matter since the beginning. He also said that he is guilty because of that. This petition deserves to be dismissed. There are not many decisions on this matter. That is fairness. They expect us to be fair. He also appealed to me to see his impartiality.

Kejriwal responsible for his affairs: 'ED'

Why was Kejriwal arrested in the middle of the election?

What is the new liquor policy in Delhi?
